NextGen200 Construction (“NextGen200,” “we,” “us,” or “our”) respects your privacy. This policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, submit a lead form or inquiry, request an estimate, engage us for construction services, or otherwise communicate with us.

This policy is intended to reflect applicable Canadian privacy requirements, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where it applies. It does not apply to information about employees or job applicants that is handled under separate internal practices.

1. Personal information we collect

“Personal information” means information about an identifiable individual. Depending on how you interact with us, we may collect:

  • Contact information. Your name, email address, telephone number, mailing address, and preferred contact method.
  • Project information. Project address, property type, requested services, budget range, desired timeline, plans, photographs, measurements, access details, and information you include in a project description.
  • Inquiry and communication records. Messages, call notes, appointment details, estimate requests, feedback, and correspondence with our team.
  • Business and transaction information. Company name, role, contract details, invoices, payment status, warranties, and records required to provide or administer services. Payment-card details may be handled directly by a payment provider rather than stored by us.
  • Website and device information. If enabled on our website, this may include Internet Protocol address, browser type, device information, pages viewed, referral source, and interactions captured through cookies or similar technologies.
  • Information you choose to provide. Any other information you voluntarily submit. Please avoid sending sensitive personal information unless it is necessary for your request.

2. How we collect information

We may collect personal information in the following ways:

  • Directly from you. For example, when you call, email, use our website, complete a quote request, sign a contract, provide project documentation, or communicate with us during a project.
  • Through advertising and social platforms. For example, when you submit an Instant Form or otherwise respond to a NextGen200 advertisement on Facebook, Instagram, or another Meta service. The platform may provide us with the information you entered and related lead details.
  • Our website and service providers may use cookies, pixels, analytics, or similar technologies where they are enabled.
  • From third parties. With appropriate authority, we may receive information from property owners, project representatives, subcontractors, suppliers, referral partners, professional advisers, or publicly available sources.

3. How we use personal information

We use personal information for purposes that a reasonable person would consider appropriate in the circumstances, including to:

  • Respond to inquiries and determine whether a project is a fit;
  • Prepare estimates, proposals, schedules, scopes of work, contracts, and project records;
  • Plan, coordinate, perform, document, and support construction or renovation services;
  • Communicate about appointments, site visits, project status, changes, payments, warranties, and service matters;
  • Verify information, manage customer and supplier relationships, and maintain business and tax records;
  • Operate, secure, troubleshoot, and improve our website, advertising, lead handling, and services;
  • Measure advertising performance and understand how people find or interact with us, where permitted;
  • Send promotional communications where we have consent or are otherwise permitted by law; and
  • Protect our rights, property, systems, customers, workers, and the public, and comply with legal or regulatory obligations.

4. Consent and your choices

We seek consent when required and may rely on express or implied consent depending on the sensitivity of the information and the context. By voluntarily providing personal information for an inquiry, estimate, or project, you consent to its handling for purposes that are explained at the time or reasonably connected to your request.

You may withdraw consent, subject to reasonable notice and any legal or contractual restrictions. Withdrawal may affect our ability to respond, provide an estimate, or continue a service. We may retain certain information when required by law or reasonably necessary for contracts, claims, warranties, accounting, safety, or dispute resolution.

Marketing messages will include an unsubscribe option where required. You may also ask us to stop promotional communications at any time. Transactional or service messages related to an active inquiry, estimate, contract, or project may continue when necessary.

5. When we disclose information

We may disclose personal information only as reasonably necessary for the purposes described in this policy, including to:

  • Service providers. Website hosts, cloud and email providers, customer-management systems, advertising and analytics platforms, payment processors, accountants, legal advisers, and other providers that support our operations.
  • Project participants. Subcontractors, trades, suppliers, consultants, engineers, designers, inspectors, utilities, property managers, and other parties involved in quoting, planning, or delivering a project, limited to what they need for their role.
  • Business transactions. A prospective or completed purchaser, successor, lender, or adviser in connection with a financing, reorganization, sale, or transfer of all or part of our business, subject to appropriate confidentiality measures.
  • Legal and safety purposes. Government, law-enforcement, regulatory, insurance, or other parties where required or permitted by law, or where reasonably necessary to protect rights, safety, property, or prevent fraud.

We do not sell or rent personal information. We may use de-identified or aggregated information that does not reasonably identify an individual for business analysis and service improvement.

6. Meta lead forms and advertising

When you submit a lead form on Facebook or Instagram, Meta first processes your information under its own terms and privacy policy. Meta then makes the lead information you submitted available to NextGen200. We use that information to contact you about your requested construction or renovation services, assess your project, and manage follow-up.

Depending on your settings and our advertising configuration, Meta may also process information about your interaction with an advertisement. You can manage certain advertising preferences in your Meta account. NextGen200 does not control Meta’s independent collection, use, retention, or disclosure practices.

7. Cookies and analytics

Our website may use cookies and similar technologies to operate, remember preferences, understand site usage, measure advertising, and improve performance. Some technologies may be placed by third-party providers. The technologies actually used may change as the website and advertising tools change.

You can usually block or delete cookies through your browser settings. Doing so may affect website functionality. Where a consent tool is presented, you can use it to manage non-essential cookies.

8. Retention and safeguards

We retain personal information only as long as reasonably necessary for the purposes described in this policy and to meet legal, accounting, insurance, warranty, safety, and recordkeeping requirements. Retention periods vary depending on the type of information, the status of an inquiry or project, and applicable obligations. When information is no longer required, we take reasonable steps to delete, destroy, or de-identify it.

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information. These may include access controls, limited staff and contractor access, secure service providers, authentication, backups, and secure disposal practices. No system or method of transmission is completely secure, so absolute security cannot be guaranteed.

9. Processing outside Ontario or Canada

Some service providers, including cloud, communications, analytics, and advertising platforms, may store or process personal information outside Ontario or Canada. In those locations, information may be subject to the laws of the relevant jurisdiction and may be accessible to courts, law-enforcement, or regulatory authorities under those laws.

10. Access, correction, and privacy requests

Subject to applicable law, you may ask to access personal information we hold about you, request corrections, ask questions about our handling practices, or withdraw consent. We may need to verify your identity before responding. In limited circumstances, the law may allow or require us to refuse access; if so, we will explain the reason where permitted.

11. Third-party websites and services

Our website, advertisements, or communications may link to third-party websites or services. Their privacy practices are governed by their own policies. We encourage you to review those policies before providing personal information.

12. Children’s privacy

Our website and services are intended for adults seeking construction-related services and are not directed to children. We do not knowingly collect personal information from children without appropriate consent. If you believe a child has provided personal information to us, please contact us so we can review and address the matter.

13. Changes to this policy

We may update this policy to reflect changes in our practices, services, technology, or legal obligations. The revised version will be posted with a new effective date. Material changes may be communicated in another appropriate manner where required.
